Terms of Service

Plain language. No dark patterns. These terms cover what the service is, what you can expect from it, and what we expect from you.

1. What Orgasmly is

Orgasmly (orgasmly.org) is a personal data-tracking application for sexual wellness. It lets you log sessions, track patterns, and optionally contribute to anonymous population-level research. It is a web app โ€” there is no native mobile app, and it has no advertising, no subscription, and no tiered features.

The service is free to use. We reserve the right to introduce paid features in the future, but any currently free features will remain free.

2. Who can use it

You must be at least 18 years old to create an account. By creating an account, you confirm that you are 18 or older. If we become aware that an account belongs to someone under 18, we will delete it.

You must be a human individual. Automated account creation is not permitted.

3. Your account

You are responsible for keeping your account credentials secure. We use email-based authentication via AWS Cognito. We do not store passwords โ€” Cognito handles credential management.

One account per person. Do not create accounts on behalf of others or share access to your account.

You can delete your account at any time from Settings. Deletion is immediate and irreversible โ€” all your data is purged.

4. Your data

You own your data. We do not claim any rights to the content you submit. The data you enter โ€” session logs, notes, tags โ€” belongs to you.

You grant us a limited, non-exclusive licence to store and process your data solely to operate the service on your behalf. This licence ends when you delete your account or a particular session.

By opting into global analytics, you grant a separate licence to include your anonymised session fields in aggregate statistics. This licence is revocable at any time by toggling off global analytics in Settings, and revocation is retroactive.

You can export all your data at any time in JSON format via Settings โ†’ Export data.

5. Acceptable use

You may not:

  • Use Orgasmly to track another person without their knowledge and consent
  • Attempt to reverse-engineer other users' data from published aggregate statistics
  • Submit false data with the intent to corrupt population analytics
  • Probe, scrape, or stress-test the API beyond normal use
  • Attempt to circumvent authentication, access controls, or rate limits
  • Use the service for any illegal purpose under applicable law

The service is for personal use only. You may not use it to build products or services without our written permission.

6. Content you submit

The free-text notes and tags you enter are private by default and visible only to you. You are responsible for the content you enter. Do not enter the personal data of other people (real names, contact information, identifying details) in notes or partner labels.

If you use share links, you voluntarily make a subset of your aggregate stats visible to anyone with the link URL. You control the scope and expiry of share links, and you can revoke them at any time.

7. Service availability

We aim for high availability but make no uptime guarantees. The service is provided as-is. Scheduled maintenance, AWS outages, or unexpected failures may cause temporary unavailability.

We reserve the right to modify or discontinue the service with reasonable notice. If we decide to shut down permanently, we will give at least 30 days' notice and provide a data export mechanism.

8. Limitation of liability

To the maximum extent permitted by law, Orgasmly is provided "as is" without any warranty, express or implied. We are not liable for any loss of data, loss of access, or any other damages arising from your use of the service.

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

If you are an Australian consumer, you have rights under the Australian Consumer Law that cannot be excluded by these terms.

9. Governing law

These terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

If you are located in the European Economic Area, your consumer rights under applicable EU law are not affected by this clause.

10. Changes to these terms

We may update these terms. Material changes will be communicated via in-app notice or email. Continued use after the effective date of a change constitutes acceptance. If you disagree with a change, your remedy is to delete your account and stop using the service.
